Presgrove estate granted subpoena for OHP docs

A judge has approved a subpoena for Oklahoma Highway Patrol documents related to the 2023 death of Noah Presgrove, whose body was found with significant blunt force injuries along U.S. Highway 81 in Terral.
The estate of Noah Presgrove filed a motion for the subpoena, which Judge Lawrence Wheeler granted on Monday. The estate is pursuing a wrongful death lawsuit, alleging Presgrove, a minor, was unlawfully provided alcohol at a gathering hosted by the defendants before his death. The lawsuit claims an altercation preceded his disappearance from the event.
According to the motion, the Oklahoma Highway Patrol (OHP) initiated an investigation into Presgrove’s death but publicly stated in May 2024 in a story printed in The Comanche Times that it was no longer investigating the case as a murder.
Attorneys for the estate argue that the material discovered by OHP is likely to lead to admissible evidence crucial for identifying potential defendants, currently listed as John/Jane Does A-Z. The estate emphasized the need for these documents to serve all potential defendants before the statute of limitations expires in September 2025.
The subpoena seeks various documents from OHP’s investigative file, including:
* All investigative reports and summaries concerning the death.
* All photographic, audio, or video evidence related to the investigation.
* Statements from any witnesses interviewed.
* Medical and autopsy reports generated or collected by OHP.
* All communications among OHP personnel regarding the investigation and findings.
* Any laboratory analysis or forensic reports obtained.
* Any geolocation data, cell site location information (CSLI), or geofencing data collected or used.
* Any other documents or records in possession of OHP specifically relating to Noah Presgrove.
The estate stated that OHP’s investigation into Presgrove’s death, particularly concerning criminal murder charges, has effectively concluded, and no criminal charges have been formally filed against the named defendants or any individuals at this time. Therefore, the request for documents pertains strictly to the OHP investigation of Presgrove’s death itself and does not implicate any pending criminal charges.
