THE BOARD OF STEPHENS COUNTY COMMISSIONERS met in regular session September 2, 2025 with Todd Churchman, Chairman, present; Kreg Murphree, Vice-Chairman, present; Russell Morgan, Member, present; and Jenny Moore, County Clerk, present.

Chairman Churchman called the meeting to order.
Motion by Morgan, seconded by Churchman to approve minutes of the previous meeting. Voting: Churchman, aye; Murphree, abstain; Morgan, aye.
Motion by Morgan, seconded by Murphree to approve the payment of purchase orders and issuance of blanket purchase orders. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
The Board heard from Construction Manager, Butch Lawson, regarding the ARPA grant and/or ARPA projects for Stephens County. Lawson reported that the painters worked at the Fairgrounds all weekend. Concrete work on the front steps has begun. Lawson presented three change orders regarding the Fire Suppression System to the Board. The Fire Suppression System needs to be moved from its current location. The three change orders total $10,314.00 and affect package #21, package #26, and package #9 for Bid #2024-21: Stephens County Fairgrounds ARPA Project. Motion by Morgan, seconded by Churchman to approve the three change orders. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
Motion by Morgan, seconded by Churchman to approve a change order for Bid #2025-15: Corum VFD New Building in the amount of $3,815.00 for the addition of a septic tank by Farmers Plumbing. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
Josette Ford, Administrator of the Estate of Michael Ford, deceased, vs. Board of County Commissioners for Stephens County, et al., Case NO. CIV-23-646-HE, United States District Court for the Western District of Oklahoma. Motion by Churchman, seconded by Morgan to enter into Executive Session, upon the advice of legal counsel, for the purpose of confidential communications between the Board and its attorney concerning the lawsuit previously referenced. Public disclosure of these confidential communications would seriously impair the ability of the Board and its attorney to properly process and defend this litigation. As such, communications in this Executive Session are confidential. AUTHORITY: Title 25 O.S. § 307(B)(4). Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Morgan, seconded by Murphree to approve an Engagement Letter between Stephens County (the County) and the Office of the Oklahoma State Auditor and Inspector for the audit of Fiscal Year 2025 and will include an audit of the Coronavirus State and Local Fiscal Recovery Funds (CSLFRF). Motion by Churchman, seconded by Murphree to approve signing a Letter to be sent to all county departments regarding procedures for Tort Claims, Insurance, Inventory, and Workers Comp. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
Motion by Morgan, seconded by Churchman to table approval for one (1) week of a Preventative Maintenance Agreement by and between Nixon Power Services and Stephens County for a Kohler KG150 Generator for Fiscal Year 2025-2026. Motion by Murphree, seconded by Churchman to approve Interlocal Cooperation Agreement #2025-237 by and between the Independent School District No. 15 of Atoka County a/k/a Atoka Public Schools (“APS”) and Stephens County, pursuant to Okla. Stat. tit. 61 § 101, et. seq., and the Interlocal Cooperation Act (“the Act”), Okla. Stat. tit. 74 § 1001, et. seq. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
The Board acknowledged the Appointment of Dr. Allon Gillispie as a member of the Stephens County Board of Health through June 30, 2027.
Motion by Murphree, seconded by Morgan to approve the Assessor’s Office GIS Application for the Oklahoma 911 Management Authority FY2026 Grant in the amount of $5,000.00. First Deputy Assessor, Mackenzie Payne, informed the Board that the County has all been mapped, but the information is not in the correct format to be uploaded into the new State system. This grant will cover the cost of reformatting the information. This process is required for continued funding of 911 money. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
Motion by Morgan, seconded by Murphree to adopt Resolution #2025-100 to Reimburse the General Fund and direct the Stephens County Treasurer to deposit check #491231 from American Fidelity in the amount of $14.20 into the Matching Benefits General Fund account described as 0001-1-2000-1200 (R-7) for the purpose of reimbursing an overpayment on cancer premiums. Voting: Churchman, aye; Murphree, aye; Morgan, aye.

Motion by Morgan, seconded by Churchman to approve a 2026 REAP Application for Stephens County Rural Water District #3 – Fire Hydrant Improvement Project sponsored by District #3. Motion by Murphree, seconded by Churchman to approve Rental Agreement (B969928) #2025-238 for Motorgrader S/N: 0N9B00831 and approve Rental Agreement (B96929) #2025-239 for Motorgrader S/N: 0ND01277 by and between Warren Cat Rental Store and Stephens County on behalf of District #1. Motion by Murphree, seconded by Morgan to approve Cooperative Agreement #2025-240 for the purpose of making conservation works of improvement to diminish erosion and siltation of right-of-way between Wayne McKinney and Stephens County. The County will remove trees and reblade the barditch for approximately five-tenths (.5) mile along the south boundary of Section 21, Township 2 North, Range 8 West in District #1. Voting: Churchman, aye; Murphree, aye; Morgan, aye.
Motion by Morgan, seconded by Murphree to approve a Cooperative Agreement #2025-241 for the purpose of making conservation works of improvement to diminish erosion and siltation of right-of-way between Josh Morgan and Stephens County. The County will remove trees and grade ditch for approximately ¼ mile along the East boundary of Section 30, Township 2 South, Range 6 West in District #3. Motion by Murphree, seconded by Morgan to approve Stephens County Fair & Expo Center Rental Agreement #2025-242 by and between the Stephens County Fair & Expo Center “Fairgrounds” by and through the Stephens County Board of County Commissioners and Diane Petty for a Christmas Party event to be held in the Heritage Room on December 13, 2025. Motion by Morgan, seconded by Churchman to approve Stephens County Fair & Expo Center Rental Agreement #2025-243 by and between the Stephens County Fair & Expo Center “Fairgrounds” by and through the Stephens County Board of County Commissioners and Duncan High School for the Duncan High School Graduation event to be held in the Stephens County Arena on May 21, 2025. Commissioner Morgan wanted to report to the Board updates regarding the Stephens County Fair & Expo Center. Morgan thought it would be a good idea to decide on a date for the County’s annual Christmas Dinner, since dates in December were filling up. The Board thought December 8, 2025 would be a good date to schedule. Morgan reminded fellow members that September 23rd and September 24th were the dates that each district will be helping haul sand for the Fairgrounds. The morning of September 24th is the open enrollment date scheduled for the Fairgrounds and all three Highway Districts. Morgan said that the work being done on the Fairgrounds Project includes painting in the conference center and pouring concrete for the entry steps.

Bids will be accepted until 10:00 o’clock A.M. on Thursday, August 28, 2025 at the City of Comanche City Hall, 500 N. Rodeo Dr., Comanche, OK. 73529 where all the bids received will be opened and read aloud. The bid opening is open to the public and all bidders. Bids will be awarded at the next regular City of Comanche Council Meeting. Chairman Churchman called the meeting to order.

Motion by Morgan, seconded by Murphree to approve an Application for Permit – Commercial Right of Way Activity & Roadway Borings from WW Builders, Inc., to erect, construct, and maintain a waterline along, upon, or across said county highway or road(s) for the purpo9se of transporting, selling, and using water in Section 25, Township 2 North, Range 9 West in District #1. The Board heard from Construction Manager, Butch Lawson, regarding the ARPA grant and/or ARPA projects for Stephens County. Lawson gave a report regarding the Fairgrounds Upgrade first. The concrete vendor is still working. The arena is being cleaned out so that the lights can be hung before the Fair. Lawson will check to see if a fiber line is scheduled for boring. Electricians are working inside the new conference center area. Regarding the courtroom, Lawson reported that the painters are actively working. Dropped ceiling tiles have been installed. Lawson said that some materials may not be delivered before the beginning of the August jury docket. If materials are delayed, work will pause during the August jury term and then begin again until the beginning of the October jury term.
Motion by Morgan, seconded by Murphree to enter into Executive Session related to the following: Sarah Hicks, as Special Administrator of the Estate of Mickey Anderson, Deceased v. Motion by Murphree, seconded by Churchman to approve Agreement #2025-210 between the City of Comanche and the Board of County Commissioners of Stephens County for the detention of persons in the Stephens County Jail who have been arrested for violations of municipal or state criminal law by the Comanche Police Department for Fiscal Year 2025-2026, to be renewed each fiscal year unless terminated by either party upon the presentation of a sixty (60) day written notice.
