Stephens County Commissioner Minutes

THE BOARD OF STEPHENS COUNTY COMMISSIONERS met in regular session November 25, 2024 with Russell Morgan, Chairman, present; Kreg Murphree, Vice-Chairman, present; Todd Churchman, Member, present; and Jenny Moore, County Clerk, present.

Others present: List in County Clerk’s Office.

Agenda filed 11-20-24 at 3:30 P.M. at the front entrance of the Courthouse and the Commissioners’ meeting room. 

Chairman Morgan called the meeting to order.

Motion by Morgan, seconded by Churchman to approve minutes of the previous meeting.  Voting: Morgan, aye; Murphree, abstain; Churchman, aye.

Motion by Murphree, seconded by Churchman to approve the payment of purchase orders, including overages on blanket purchase order #227 in the amount of $1,552.00 from the General Fund and blanket purchase order #456 in the amount of $20.00 from the Jail-ST Fund, and issuance of blanket purchase orders.  Voting: Morgan, aye; Murphree, aye; Churchman, aye.

Motion by Murphree, seconded by Morgan to approve an Application for Permit – Commercial Right of Way Activity & Roadway Borings from Ovintiv Oil & Gas to erect, construct, and maintain a temporary water line along, upon, or across the county highways or road(s) for the purpose of transporting, selling, and using water to 3050 CR roadway approximately 515’ north from the SW corner of Sections 19 and 24, Township 2 North, Range 4 West in District #1.  Voting: Morgan, aye; Murphree, aye; Churchman, aye.

The Board heard from Butch Lawson, Construction Division Operations Manager, regarding the ARPA grant and/or ARPA projects for Stephens County.  Lawson reported that there was a good turnout for the pre-bid meeting held on Thursday for the second floor courthouse remodel project. Lawson expects a slower week on the Fairgrounds project due to the Thanksgiving holiday. Chairman Morgan signed the Certificate of Substantial Completion for the Courthouse Annex presented to the Board by ARC Architecture, LLC.

The Board discussed the Refinery Property owned by Stephens County.  Commissioner Morgan would like Phillips 66 and DEQ to join the Board for further discussions, but Morgan shared with fellow Board members some of items he had learned from discussions with Tom Wynn from Phillips 66.  The ballpark area will need to be separated.  There will be no restrictions on its recreational use.  There will be deed restrictions on the remainder of the property.  The containment area will forever be in the county’s possession.  Commissioner Churchman expressed concern with the county’s liability once retaining ownership.  Churchman would like the liability addressed in writing.  Morgan thinks the 45 acres that Phillips 66 bought from Kenny Miller will need to be addressed.  DEQ would like the property surveyed, although it is not required.  Morgan thinks Phillips should pay for that survey.  No action was taken by the Board.

The Board opened six-month Bid #2025-5 for Rock to be picked up by county trucks with prices effective January 1, 2025 through June 30, 2025.  Bids were accepted from: Dolese Bros. Co., 8300 N. Oklahoma Ave., Oklahoma City, OK 73114; Vulcan Materials Co., 10101 Reunion Place, Ste #5, San Antonio, Texas 78216; and Western Aggregates, LLC, 8251 W. The Board opened six-month Bid #2025-6 for Concrete to be used by Stephens County at various locations and project sites within the County with prices effective January 1, 2025 through June 30, 2025.  Voting: Morgan, aye; Murphree, aye; Churchman, aye. One bid was accepted from Dolese, 8300 N. Oklahoma Ave., Oklahoma City, OK 73114.  Motion by Morgan, seconded by Churchman to award bid to Dolese. Voting: Morgan, aye; Murphree, aye; Churchman, aye.  Bid awarded as follows: 4-1/2 sack mix $170.00; 5 sack mix $174.00; 5-1/2 sack mix $178.00; 6 sack mix $178.00; Class AA-4000 PSI Concrete $182.00.

Motion by Murphree, seconded by Churchman to approve Stephens County Fair & Expo Center Rental Agreement #2024-274 by and between the Stephens County Fair & Expo Center “Fairgrounds” by and through the Stephens County Board of County Commissioners and June Covington for the Bible Methodist Church Christmas Dinner event to be held in the Harvest Room on December 17, 2024.  Voting: Morgan, aye; Murphree, aye; Churchman, aye.

Commissioner Morgan did not have any new updates to report to the Board regarding the Stephens County Fair & Expo Center.

RESOLUTION 396-24

NOTICE OF ELECTION

CITY OF COMANCHE, OKLAHOMA

 

BE IT RESOLVED by the governing body of the City of Comanche that for the purpose of electing officers of said city that: A non-partisan general election, if needed, shall be held on Tuesday, April 1, 2025; and

BE IT FURTHER RESOLVED that the filing period for electing officers of the City of Comanche shall begin 8:00 a.m. on Monday, February 3, 2025, and close Wednesday, February 5, 2025, at 5:00 p.m.

BE IT FURTHER RESOLVED that the officers of the City of Comanche to be elected are nominated by ward and elected at large.

BE IT FURTHER RESOLVED that the following officers will be elected with the designated terms: 

Councilmember Ward III and Councilmember Ward IV will be elected to fill an unexpired term ending the first Monday of May, 2027,

Councilmember Ward I and Councilmember Ward II will be elected to four (4) year terms to expire the first Monday of May, 2029.

BE IT FURTHER RESOLVED that each candidate must be a qualified elector by virtue of being a resident and registered voter within the municipality, or in the ward if an office is from a ward, for at least six (6) months prior to filing a declaration of candidacy. 

BE IT FURTHER RESOLVED that absentee ballots will be provided in accordance with State Law. 

BE IT FURTHER RESOLVED that the City of Comanche City Limits include Precincts 690041, 690061, 690062, and 690063 in Stephens County and Precinct 340103 in Jefferson County.

BE IT FURTHER RESOLVED that no persons reside in Precincts 690061, 690062, and 690063 in Stephens County and Precinct 340103 in Jefferson County that can vote in the municipal election on April 1, 2025 due to the annexation of 200 feet strips.

The Board heard from Ken Shaw, Construction Manager, and/or Russell Morgan regarding the ARPA grant and/or ARPA projects for Stephens County.  Shaw reported that WW Builders should begin digging the site utilities at the Fairgrounds this week.  The rebar should be delivered next Friday.  The metal building for the Fairgrounds project is in production.  Shaw stated that there will be a mandatory pre-bid meeting for the 2nd floor remodel project of the courthouse held on November 21st at 10:30 A.M.  Shaw asked that a reminder email be sent to all department heads on the 2nd floor.  Clerk Moore will make sure that an email is sent.

Commissioner Morgan wanted to report to the Board updates regarding the Stephens County Fair & Expo Center.  Morgan reported that there was a big barrel race event that took place at the Fairgrounds this past weekend.

New Business: Commissioner Morgan reported that he had been sent a list of new laws that went into effect November 1, 2024.  Morgan asked ADA Sifers for an opinion regarding a new law relating to indigent persons and the Board’s responsibilities pertaining to their care.

New Business:  Election Board Secretary, Shawnda Seely, expressed her appreciation to the Board and to the Maintenance Department for all of the help prior to and during early voting at the Election Board.  Seely saw a very large number of people taking advantage of in-person early voting.  The process was a success.
